1. Overview

  • Related regulations
    • Articled  10 through 8 of the Act on the Control of Transboundary Movement of Hazardous Wastes and their Disposal.
  • Licenser:The Minister of the Environment (entrusted to basin environment director)
  • Requirement for a license.
    • When it has a facility and techniques for environmentally sound waste disposal.
    • When an importing country requires waste as a resource for recycling industry.
  • Revision permission
    • Revision of exporter or importer
    • Revision of name, physical properties, chemical composition of waste
    • Revision of planed amount of export waste
    • Revision of disposal or recycling method or waste disposal location
    • Revision of domestic customs or destination port
    • Revision of  Customs or the competent authorities of the export or transit country
  • Inclusive import
    • When physical and chemical properties or, domestic regulations and Customs of import country and import-export traders are the same
    • Possible within one year
  • Management of imported wastes
    • Fill out the import document : when imported waste originates from the Free Trade Zone
    • Submission of transfer report : within 5 days
    • Report result of treatment : within 10 days after completion of treatment

  • Report for waste import and attached papers(refer to bottom)
    • Length of process : 10 days(after submission of request document for import consent)
    • ※ With the Exception of the import consent and transit consent period

      • ① Import contract or order include import price specified by the C.I.F with such information showing that the  waste is managed in an environmentally sound way
      • ② Document includes characteristics and uses of imported wastes
      • ③ Domestic transportation contract includes transportation route, method and transporter of import waste
      • ④ In cases of inclusive import, plan include customs, import due date or import amount by date(month)
      • ⑤ Payment receipt of waste import permission fees
      • ⑥ Disposal or recycling uses, manual and process diagram of imported wastes
      • ⑦ Installation document of disposal or recycling facilities of imported wastes
      • ⑧ Waste disposal plan after recycling
      • ⑨ In cases of imports on commission , commission contract
      • ⑩ Original document of waste import permission(revision permission)
      • ⑪ Certificate document for revision(revision permission)

4. Item list for permission

  • ① Wastes with the hazardous properties referred to in Annex 2 or Annex 8 of the Basel Convention on the Control of Transboundary Movement of Hazardous Wastes and their Disposal
  • ② The wastes referred to in Annex 2 of the Basel Convention .
  • Waste that our country informed or was notified by the Convention Bureau under Convention Para. 1 or Para. 3 of Article 3 and Article 11
    • Wastes considered or defined to be hazardous under its domestic law or substances which are determined as necessary for the regulation of export and import by bilateral, multilateral or regional agreements
  • ④ Items notified by the Minister of Environment in consultation with the Minister of Commerce, Industry and Energy(Notification No. 2007-188 of the Ministry of Environment)
  • ⑤ Waste Exclusion
    • Radioactive substances prescribed in the Atomic Energy Act and substances contaminated thereby
    • Wastes discharged in sea areas pursuant to the Marine Environment Management Act, and wastes discharged as a result of the navigation of ships

  • Licenser
    • The Minister of the Environment (entrusts the basin environment director)
  • Exporters and importers
    • The general public - acts simply as a proxy of exportation for a producer.
    • Waste transactor - person who disposes of waste or establishes a waste disposal facility
  • Requirements for a license
    • When it has failed to develop a facility and techniques for environmentally sound waste disposal
    • When an importing country requries waste as a resource for recycling industry
  • Revision permission
    • Revision of name, physical properties, chemical composition of waste
    • Revision of amount of exported waste
    • Revision of disposal or recycling method and waste disposal location
    • Revision of Customs or the competent authorities of import or transit country
  • Inclusive export
    • When physical and chemical properties or, domestic and overseas import-export Customs and traders are the same
    • Possible within one year

3. Requirement document

  • Report for waste import and attached papers(refer to bottom)
    • Length of process : 12 days( with the -exception of the import consent and transit consent period)
    • attached papers for export permission(revision) report

      • ① Export contract or order include export price specified by the F.O.B with information showing that  waste is managed in an environmentally sound managed
      • ② Domestic transportation contract includes the transportation route, method and transporter of export waste
      • ③ In cases of waste noted by the Minister of the Environment, examine the report of export waste conducted by institutions designated or notarized by the Minister of the Environment
      • ④ In cases of export on commission-, commission contracts, etc, a supporting reference about interactions with the exporter
      • ⑤ In cases of inclusive export, an inclusive export plan including customs, export due date or export amount by date(month)
      • ⑥ Payment receipt of waste export permission fees
      • ⑦ Insurance policy or other warranty under Convention regulations Para. 11 Article 6 when requested by the import  or transit country
      • ⑧ Original document of waste import permission(revision permission)
      • ⑨ Certificate document for revision(revision permission)

    • Wastes discharged in sea areas pursuant to the Marine Environment Management Act and wastes discharged as a result of the navigation of ships
